measures to liquidate the project ‫وإﯾﺪاﻋﮫ ﻓﻲ أﺣﺪ اﻟﻤﺼﺎرف ﺑﻌﺪ‬
and deposit the resulting funds in a
bank account after paying any .‫إﺳﺘﯿﻔﺎء أي ﺣﻘﻮق ﻟﻠﺪوﻟﺔ أو ﻟﻠﻐﯿﺮ‬
amounts due to the State or others.
‫ﯾﺠﻮز ﻟﻸطﺮاف اﻟﺨﺎﺿﻌﺔ ﻷﺣﻜﺎم ﻗﺎﻧﻮن‬ •
• Any parties subject to provisions of the ‫اﻹﺳﺘﺜﻤﺎر اﻹﺗﻔﺎق ﻋﻠﻰ آﻟﯿﺔ ﻟﺤﻞ أي ﻧﺰاﻋﺎت‬

a mechanism to resolve disputes
including arbitration pursuant to Iraqi .‫اﻟﻌﺮاﻗﻲ أو اي ﺟﮭﺔ آﺧﺮى ﻣﻌﺘﺮف ﺑﮭﺎ‬
law or any other recognized entity.55

• Disputes that arise between the NIC (or ‫اﻟﻨﺰاﻋﺎت اﻟﺘﻲ ﺗﻨﺸﺄ ﺑﯿﻦ اﻟﮭﯿﺌﺔ )أو ﺟﮭﺔ‬ •
other government entity) and any of ‫ﺣﻜﻮﻣﯿﺔ( وأي ﻣﻦ ھﺆﻻء اﻟﺨﺎﺿﻌﯿﻦ ﻷﺣﻜﺎم‬

not related to violations of the National
Investment Law are subject to Iraqi .‫واﻟﻤﺤﺎﻛﻢ اﻟﻌﺮاﻗﯿﺔ ﻓﻲ اﻟﻤﺴﺎﺋﻞ اﻟﻤﺪﻧﯿﺔ‬
laws and Iraqi courts on civil matters.
‫• ﺑﺎﻟﻨﺴﺒﺔ ﻟﻠﻨﺰاﻋﺎت اﻟﺘﺠﺎرﯾﺔ ﯾﺠﻮز ﻟﻸطﺮاف‬
• For commercial disputes, parties may ‫اﻟﻠﺠﻮء إﻟﻰ اﻟﺘﺤﻜﯿﻢ إذا ﻧ ّﺺ اﻟﻌﻘﺪ اﻟﻤﻨﻈﻢ‬
resort to arbitration if an arrangement
stipulated in the contract organizing the . ‫ﻟﻠﻌﻼﻗﺔ ﺑﯿﻦ اﻻطﺮاف ﻋﻠﻰ ذﻟﻚ‬
relationship between parties in
accordance with the requirements
outlined in Iraqi laws.
