2. Investor Violations ‫ ﻣﺨﺎﻟﻔﺎت اﻟﻤﺴﺘﺜﻤﺮ‬.2

If the investor violates any conditions of ‫إذا ﺧﺎﻟﻒ اﻟﻤﺴﺘﺜﻤﺮ أي ﺷﺮط ﻣﻦ ﺷﺮوط ﻗﺎﻧﻮن‬
the National Investment Law, the NIC :‫اﻹﺳﺘﺜﻤﺎر ﺗﺤﺘﻔﻆ اﻟﮭﯿﺌﺔ ﺑﺤﻘﮭﺎ ﻓﻲ‬
reserves the right to: 56
‫• إﻧﺬار اﻟﻤﺴﺘﺜﻤﺮ ﻛﺘﺎﺑﯿﺎً ﻹزاﻟﺔ اﻟﻤﺨﺎﻟﻔﺔ ﺧﻼل‬
• Warn the investor in writing to remedy .‫ﻣﺪة ﻣﻌﯿﻨﺔ ﻣﻦ اﻟﻮﻗﺖ‬
the violation within a specific period.
‫إذا ﻟﻢ ﯾﻌﺎﻟﺞ اﻟﻤﺴﺘﺜﻤﺮ اﻟﻤﺨﺎﻟﻔﺔ ﺧﻼل‬ o
o If the investor does not remedy the ‫اﻟﻤﺪة اﻟﻤﺤﺪدة ﻓﻲ اﻹﻧﺬار ﯾﻤﻜﻦ ﻟﻠﮭﯿﺌﺔ‬
violation within the specified ‫أن ﺗﻄﻠﺐ ﻣﻦ اﻟﻤﺴﺘﺜﻤﺮ إﯾﺠﺎد ﺧﯿﺎرات‬
period, the NIC can request the
investor to perform other settlement .‫أﺧﺮى ﻟﻠﺘﺴﻮﯾﺔ‬
options.
‫• إذا ﺗﻜﺮرت اﻟﻤﺨﺎﻟﻔﺔ أو ﻟﻢ ﯾﺘﻢ إزاﻟﺘﮭﺎ ﺧﻼل‬
• If a violation is repeated or not ‫ ﺗﺤﺘﻔﻆ اﻟﮭﯿﺌﺔ‬،‫اﻟﻤﺪة اﻟﻤﺤﺪدة ﻓﻲ اﻻﻧﺬار‬
remedied within the specific period
established in the warning, the NIC :‫ﻟﻨﻔﺴﮭﺎ ﺑﺤﻘﮭﺎ ﻓﻲ‬
reserves the right to:57
‫ ﺳﺤﺐ إﺟﺎزة اﻹﺳﺘﺜﻤﺎر اﻟﺘﻲ أﺻﺪرﺗﮭﺎ‬o
o Withdraw the investor’s license .‫واﻷﻣﺮ ﺑﻮﻗﻒ اﻟﻌﻤﻞ ﻓﻲ اﻟﻤﺸﺮوع‬
issued by the NIC and order a
stoppage of work on the project; ‫ﺗﺤﺘﻔﻆ اﻟﺪوﻟﺔ ﺑﺤﻘﮭﺎ ﻓﻲ ﺣﺮﻣﺎن‬ o
‫اﻟﻤﺴﺘﺜﻤﺮ ﻣﻦ اﻹﻋﻔﺎءات واﻹﻣﺘﯿﺎزات‬
o Retain the State’s right to deny the
investor, commencing on the date .‫اﻟﻤﻤﻨﻮﺣﺔ ﺑﺪ ًء ﻣﻦ ﺗﺎرﯾﺦ اﻟﻤﺨﺎﻟﻔﺔ‬
of the violation, the granted
exemptions and privileges; and ‫ اﻟﺴﻤﺎح ﻟﻠﻐﯿﺮ ﺑﺎﻹﺣﺘﻔﺎظ ﺑﺤﻘﻮﻗﮭﻢ‬o
‫ﺑﺎﻟﻤﻄﺎﻟﺒﺔ ﺑﺎﻟﺘﻌﻮﯾﺾ ﻋﻦ اﻷﺿﺮار‬
o Allow others to retain their rights to
demand compensation for the .‫اﻟﺘﻲ ﺳﺒﺒﺘﮭﺎ اﻟﻤﺨﺎﻟﻔﺔ‬
damage caused by the violation.
