who are subject to the provisions of ‫ إﻻ إذا ﺗﻢ‬،‫أﯾﻀﺎً ﻟﻠﻘﺎﻧﻮن اﻟﻌﺮاﻗﻲ‬

otherwise agreed.52

o With the exception of certain cases ‫ "ﺗﺨﻀﻊ‬،‫ﺑﺎﺳﺘﺜﻨﺎء ﻗﻀﺎﯾﺎ ﻣﻌﯿﻨﺔ‬ o
that will exclusively be “subject to ‫ﻟﻺﺧﺘﺼﺎص اﻟﺤﺼﺮي ﻷﺣﻜﺎم اﻟﻘﺎﻧﻮن‬
provisions of Iraqi law or the ‫اﻟﻌﺮاﻗﻲ أو إﺧﺘﺼﺎص اﻟﻤﺤﺎﻛﻢ‬
jurisdiction of Iraqi courts, such as ‫ اﻟﻨﺰاﻋﺎت اﻟﻨﺎﺷﺌﺔ ﻣﻦ ﻋﻘﺪ‬،‫اﻟﻌﺮاﻗﯿﺔ‬
disputes arising from labor ‫اﻟﻌﻤﻞ ﺳﺘﺨﻀﻊ ﻟﻺﺧﺘﺼﺎص اﻟﺤﺼﺮي‬
contracts which are exclusively ‫ﻷﺣﻜﺎم اﻟﻘﺎﻧﻮن اﻟﻌﺮاﻗﻲ وإﺧﺘﺼﺎص‬
subject to the provisions of the Iraqi
law and jurisdiction of Iraqi ."‫اﻟﻤﺤﺎﻛﻢ اﻟﻌﺮاﻗﯿﺔ‬
courts.”53

o Non-Iraqi laborers shall be subject ‫ ﯾﺨﻀﻊ اﻟﻌﻤﺎل ﻏﯿﺮ اﻟﻌﺮاﻗﯿﯿﻦ ﻟﻘﺎﻧﻮن‬o
to Iraqi labor laws unless otherwise ‫اﻟﻌﻤﻞ اﻟﻌﺮاﻗﻲ ﻣﺎﻟﻢ ﯾﻨﺺ ﻋﻘﺪ اﻟﻌﻤﻞ‬
stated in the employment contract.

• If parties to a dispute are non-Iraqis ‫إذا ﻛﺎﻧﺖ أطﺮاف اﻟﻨﺰاع ﻏﯿﺮ ﻋﺮاﻗﯿﯿﻦ وﻟﻢ‬ •
and the dispute does not arise from a ‫ ﻓﺈﻧﮫ ﯾﺠﻮز‬،‫ﯾﻨﺸﺄ اﻟﻨﺰاع ﻋﻦ ﺟﺮﯾﻤﺔ‬
crime, the opponents may agree on the ‫ﻟﻠﻤﺘﻨﺎزﻋﯿﻦ أن ﯾﺘﻔﻘﻮا ﻋﻠﻰ اﻟﻘﺎﻧﻮن اﻟﺬي‬
law to be applied, the competent court, ‫ أوﻋﻠﻰ اﻟﻤﺤﻜﻤﺔ اﻟﻤﺨﺘﺼﺔ أو ﻋﻠﻰ‬،‫ﺳﯿُﻄﺒّﻖ‬

• If a dispute arises between investors or ‫• إذا ﻧﺸﺄ ﻧﺰاع ﺑﯿﻦ ﻣﺴﺘﺜﻤﺮﯾﻦ أو ﺷﺮﻛﺎء ﻓﻲ‬
partners in a project subject to the ‫ ﯾﻨﺘﺞ ﻋﻨﮫ‬،‫ﻣﺸﺮوع ﺧﺎﺿﻊ ﻟﻘﺎﻧﻮن اﻹﺳﺘﺜﻤﺎر‬
