provision establishes a specific mechanism
for how to go about obtaining loans. The
new article provides for:
“Encouraging Iraqi and foreign investors to ) ﺗﺸﺠﯿﻊ اﻟﻤﺴﺘﺜﻤﺮﯾﻦ اﻟﻌﺮاﻗﯿﯿﻦ واﻻﺟﺎﻧﺐ ﺑﺎﻟﻤﺸﺎرﻛﺔ ﻣﻊ
partner with Iraqis by offering them loans اﻟﻌﺮاﻗﯿﯿﻦ ﻣﻦ ﺧﻼل ﺗﻮﻓﯿﺮ ﻗﺮوض وﺗﺴﮭﯿﻼت ﻣﺎﻟﯿﺔ ﻟﮭﻢ
and financial concessions in coordination ﺑﺎﻟﺘﻨﺴﯿﻖ ﻣﻊ وزارة اﻟﻤﺎﻟﯿﺔ واﻟﻤﺆﺳﺴﺎت اﻟﻤﺎﻟﯿﺔ اﻻﺧﺮى
with the Ministry of Finance and other ﻣﻦ اﻟﻤﺸﺮوع%25 ﻋﻠﻰ ان ﯾﺮاﻋﻰ اﻧﺠﺎز اﻟﻤﺴﺘﺜﻤﺮ ﻧﺴﺒﺔ
financial institutions, provided the investor وﺑﻀﻤﺎن ﻣﻨﺸﺄت اﻟﻤﺸﺮوع وﺗﺤﺪد ﻧﺴﺒﺔ ﻓﺎﺋﺪة ﻣﯿﺴﺮة ﺑﺎﻟﻨﺴﺒﺔ
has already completed 25% of the project, ﻟﻠﻤﺸﺎرﯾﻊ اﻟﺴﻜﻨﯿﺔ وﻟﻠﻤﺴﺘﻔﯿﺪ اﻟﻨﮭﺎﺋﻲ ﻋﻠﻰ ان ﯾﺮاﻋﻰ
using project installations as collateral, and
establishing an interest rate that is .(اﺳﺘﺨﺪام أﯾﺪي ﻋﺎﻣﻠﺔ ﻋﺮاﻗﯿﺔ ﺗﺘﻨﺎﺳﺐ وﺣﺠﻢ اﻟﻘﺮض
concessional in terms of housing projects
and the end user, provided that the use of
Iraqi labor is consistent with the size of the
loan.”
Fourth: One of the major amendments to ﻣﻦ أﺑﺮز اوﺟﮫ اﻟﺘﻌﺪﯾﻼت ﻓﻲ اﻟﻘﺎﻧﻮن اﻟﺠﺪﯾﺪ ھﻮ ﻣﺎ:راﺑﻌﺎ
the new Law is that contained in Article 6 of 10 ﻣﻦ اﻟﺘﻌﺪﯾﻞ ﺣﯿﺚ اﻟﻐﺖ ﻧﺺ اﻟﻤﺎدة6 ﺟﺎءت ﺑﮫ اﻟﻤﺎدة
the amendment, which cancels the provision ﻣﻦ اﻟﻘﺎﻧﻮن اﻟﺨﺎﺻﺔ ﺑﺘﻤﻠﻚ اﻻﺟﻨﺒﻲ واﻟﻌﺮاﻗﻲ ﻟﻸراﺿﻲ
in Article 10 of the Law on foreign and Iraqi اﻟﻤﺨﺼﺼﺔ ﻻﻗﺎﻣﺔ اﻟﻤﺸﺎرﯾﻊ اﻻﺳﺘﺜﻤﺎرﯾﺔ ﻋﻠﯿﮭﺎ واﺳﺘﺒﺪﻟﺘﮭﺎ
ownership of land allotted for building ﺑﻨﺺ ﺟﺪﯾﺪ ﯾﺤﻤﻞ رﻗﻢ اﻟﻤﺎدة ذاﺗﮭﺎ ﺗﻢ ﻣﻦ ﺧﻼﻟﮭﺎ ﻣﻨﺢ
investment projects, and replacing it with a اﻟﻤﺴﺘﺜﻤﺮ اﻟﻌﺮاﻗﻲ واﻻﺟﻨﺒﻲ ﻋﻠﻰ ﺣﺪ ﺳﻮاء ﺣﻖ ﺗﻤﻠﻚ

whereby it grants Iraqi and foreign investors ﺣﻘﮭﻤﺎ ) اي اﻟﻤﺴﺘﺜﻤﺮ اﻟﻌﺮاﻗﻲ او اﻻﺟﻨﺒﻲ ( ﻓﻲ ﺗﻤﻠﻚ
equal rights to own land for the purpose of اﻷراﺿﻲ اﻟﻤﺨﺼﺼﺔ ﻟﻠﻤﺸﺎرﯾﻊ اﻟﺼﻨﺎﻋﯿﺔ واﻟﻌﺎﺋﺪة ﻟﻠﺪوﻟﺔ
building housing projects, as well as the وھﺬا ﯾﻌﻨﻲ ان اﻟﺘﻌﺪﯾﻞ اﻟﺠﺪﯾﺪ ﻗﺪ وﺳﻊ ﻣﻦ، واﻟﻘﻄﺎع اﻟﻌﺎم
