The investor shall have the right “to take out
the capital he brought into Iraq and its
proceeds in accordance with the provisions
of this law and pursuant to the instructions of
the [CBI] in an exchangeable currency after
paying all its taxes and debts due to the Iraqi
Government and all other authorities”;
The investor shall have the right to “insure
the investment project with any foreign or
national insurance company it deems
suitable”;
The investor shall have the right to “open
accounts in Iraqi or foreign currency or both
at a bank inside or outside Iraq for the
licensed project”;
The investor shall have the right to
“participate in the Iraqi Stock Exchange, and
acquire membership in private stock and
mixed companies, even when there are
properties within the assets of said
companies”;
Moreover, the investor shall have the right
“to employ and use non-Iraqi workers in case
it is not possible to employ an Iraqi with the
required qualifications and capable of
performing the same task in accordance with
guidelines issued by the NIC.” However, the
investor should give priority to Iraqi citizens,
if possible, before hiring non-Iraqi workers;
The National Investment Law guarantees the
right of ownership and protection against
confiscation or nationalization of the
investment project, except in case of a final
judicial decision, as well as protection
against appropriation of the investment
project’s ownership, partly or in full, unless
the public interest is involved and fair
compensation is made.
In addition to the above, the NIC or PICs, in
coordination with the relevant authorities,

‫ﻛﻤﺎ أﻗﺮ اﻟﻘﺎﻧﻮن ﺣﻖ اﻟﻤﺴﺘﺜﻤﺮ ﻓﻲ "اﻟﺘﺄﻣﯿﻦ ﻋﻠﻰ‬
‫اﻟﻤﺸﺮوع اﻹﺳﺘﺜﻤﺎري ﻟﺪى أي ﺷﺮﻛﺔ ﺗﺄﻣﯿﻦ وطﻨﯿﺔ أو‬
".‫أﺟﻨﺒﯿﺔ ﯾﻌﺘﺒﺮھﺎ ﻣﻼﺋﻤﺔ‬
‫وﻟﻠﻤﺴﺘﺜﻤﺮ اﻟﺤﻖ ﻓﻲ "ﻓﺘﺢ ﺣﺴﺎﺑﺎت ﺑﺎﻟﻌﻤﻠﺔ اﻟﻌﺮاﻗﯿﺔ أو‬
‫اﻷﺟﻨﺒﯿﺔ أو ﻛﻠﯿﮭﻤﺎ ﻟﺪى أﺣﺪ اﻟﻤﺼﺎرف ﻓﻲ اﻟﻌﺮاق أو‬
".‫ﺧﺎرﺟﮫ ﻟﻠﻤﺸﺮوع اﻟﻤﺠﺎز‬
‫ﻛﻤﺎ أن ﻟﻠﻤﺴﺘﺜﻤﺮ اﻟﺤﻖ ﻓﻲ "اﻟﺘﺪاول ﻓﻲ ﺳﻮق اﻟﻌﺮاق‬
‫ﻟﻸوراق اﻟﻤﺎﻟﯿﺔ ﺑﺎﻷﺳﮭﻢ واﻟﺴﻨﺪات اﻟﻤﺪرﺟﺔ ﻓﯿﮫ‬
‫وإﻛﺘﺴﺎب اﻟﻌﻀﻮﯾﺔ ﻓﻲ اﻟﺸﺮﻛﺎت اﻟﻤﺴﺎھﻤﺔ اﻟﺨﺎﺻﺔ‬
‫ وﻻ ﯾﻤﻨﻊ ﻣﻦ ذﻟﻚ وﺟﻮد ﻋﻘﺎرات ﺿﻤﻦ‬،‫واﻟﻤﺨﺘﻠﻄﺔ‬
".‫ﻣﻮﺟﻮدات اﻟﺸﺮﻛﺎت اﻟﻤﺬﻛﻮرة‬
‫وﻧﺺ اﻟﻘﺎﻧﻮن أﯾﻀﺎَ ﻋﻠﻰ أن ﻟﻠﻤﺴﺘﺜﻤﺮ اﻟﺤﻖ ﻓﻲ‬
‫"ﺗﻮظﯿﻒ وإﺳﺘﺨﺪام ﻋﺎﻣﻠﯿﻦ ﻣﻦ ﻏﯿﺮ اﻟﻌﺮاﻗﯿﯿﻦ ﻓﻲ ﺣﺎﻟﺔ‬
‫ﻋﺪم إﻣﻜﺎﻧﯿﺔ إﺳﺘﺨﺪام ﻋﺮاﻗﻲ ﯾﻤﻠﻚ اﻟﻤﺆھﻼت اﻟﻼزﻣﺔ‬
‫وﻗﺎدر ﻋﻠﻰ اﻟﻘﯿﺎم ﺑﻨﻔﺲ اﻟﻤﮭﻤﺔ وﻓﻖ ﺿﻮاﺑﻂ ﺗﺼﺪرھﺎ‬
‫" وﻣﻊ ذﻟﻚ ﯾﺠﺐ ﻋﻠﻰ اﻟﻤﺴﺘﺜﻤﺮ أن ﯾﻌﻄﻲ‬.‫اﻟﮭﯿﺌﺔ‬

‫ﻛﻤﺎ ﺿﻤﻦ اﻟﻘﺎﻧﻮن ﺣﻖ اﻟﻤﻠﻜﯿﺔ ﻣﻦ ﺧﻼل ﻧﺼﮫ ﻋﻠﻰ‬
‫"ﻋﺪم اﻟﻤﺼﺎدرة أو ﺗﺄﻣﯿﻢ اﻟﻤﺸﺮوع اﻹﺳﺘﺜﻤﺎري ﺑﺈﺳﺘﺜﻨﺎء‬
‫ ﺑﺎﻻﺿﺎﻓﺔ اﻟﻰ ﻋﺪم ﻧﺰع ﻣﻠﻜﯿﺔ‬،‫ﻣﺎ ﯾﺘﻢ ﺑﺤﻜﻢ ﻗﻀﺎﺋﻲ ﺑﺎت‬
‫اﻟﻤﺸﺮوع اﻻﺳﺘﺜﻤﺎري إﻻ ﻟﻠﻤﻨﻔﻌﺔ اﻟﻌﺎﻣﺔ ﻛﻼ أو ﺟﺰءا‬
".‫وﺑﺘﻌﻮﯾﺾ ﻋﺎدل‬
‫ ﻓﺈن اﻟﮭﯿﺌﺔ اﻟﻮطﻨﯿﺔ ﻟﻺﺳﺘﺜﻤﺎر‬،‫ﺑﺎﻹﺿﺎﻓﺔ ﻟﻤﺎ ﺗﻘﺪم‬
‫اوھﯿﺌﺎت اﻹﺳﺘﺜﻤﺎر ﻓﻲ اﻟﻤﺤﺎﻓﻈﺎت ذات اﻟﻌﻼﻗﺔ ﺗﺘﻮﻟﻰ‬
