will provide utilities and infrastructure
services such as water, electricity, sanitation
services, roads and telecommunications, to
the perimeter of the project land, as may be
agreed in detail under the terms of the
investment contract.
Fourth – Commercial Operations
After the development, design and
construction of the investment project and
the establishment of the facilities agreed by
the parties, the investment project should
commence operations. For example, the
commercial operations of an industrial
project commences from the start date of
production of goods and/or services. At this
phase, and in accordance with the National
Investment Law, the project would be
granted a tax exemption of up to ten (10)
years and for each phase of project
implementation, which can be increased to
fifteen (15) years if the ownership ratio of
the Iraqi partnership in the project is more
than 50%.
The law also grants exemption from taxes
and fees for the primary materials necessary
for commercial operations based on the
percentage of locally-produced materials that
are used in the project. The exemption rate
increases proportionately with the percentage
of locally-produced primary materials,
except for those included under ration cards
for foodstuff, pharmaceuticals and
construction materials, all of which are fully
exempt as long as their primary materials are
not available in Iraq.
The investment project retains a valid license
until the end of the period agreed upon
between the investor and the NIC or relevant
PIC or other relevant authorities such as the
Government of Iraq’s ministries and other
bodies.
