 Investors and related parties are to
follow the procedures set forth in the
National Investment Law for dispute
settlement and investor violations
pertaining to projects covered by the
National Investment Law and related
Iraqi laws.39
 If a dispute arises between the
investment project partners resulting in
a stoppage to the project for a period
that exceeds three months, a warning
shall be sent to the investor to settle the .‫) ثلاثين يوماً من تاريخ الإنذار‬30( ‫خلال‬
dispute within 30 days of the date of
the warning. If there is no response, the
delaying investor will bear a delay
penalty that is commensurate with the
period of the delay, provided that it
does not exceed 10% of the project
capital (Article 27/Second/A of the
National Investment Law).
 The party in breach of its obligation
shall be excluded after the period
stipulated by law, which is 30 days,
and shall be replaced by the partner not
in breach, or an approved replacement.
This must be undertaken without
prejudicing the relevant Commission’s
right to revoke the investment license
after the expiration of the 30 days
period (Article 27/Second/B of the
National Investment Law).
 If an investment stoppage occurred
because of a dispute between the
investor and others, and after
considering the time period stated by
the law, the relevant Commission shall
commence the legal procedures to to
inform the project owner and liquidate
the project and deposit the liquidated
assets in a bank after deducting the

‫فإذا حصل نزاع بين الشركاء في المشروع‬ 
‫الإستثماري وترتب عليه توقف العمل‬

‫فيوجه إنذار الى المستثمر بتسوية الخلاف‬
‫ يتم تحميل المستثمر‬،‫وعند عدم الإستجابة‬

‫ بشرط أن لا يزيد مجموعها‬،‫التأخير‬

‫يستبعد الطرف المخل بإلتزاماته بعد مضي‬ 

‫أما في حالة توقف العمل في المشروع‬ 
‫الإستثماري بسبب النزاع بين المستثمر‬
‫ وبعد مراعاة المدة الزمنية‬،‫والغير‬
‫ فإن للهيئة‬،‫المنصوص عليها في القانون‬
‫إتخاذ الإجراءات القانونية بتصفية المشروع‬
‫مع إخطار مالك المشروع وإيداع مبلغ‬
‫التصفية في أحد المصارف بعد إستيفاء حق‬
‫الدولة أو أي حقوق للغير ثابتة بحكم قضائي‬
‫ إذا كان‬،‫ كما أن للغير‬،‫يقضي بإستحقاقها‬
