Financing, Subcontracting :‫الباطن و التحويل‬
and Transfers:

a. The Second Party has the right ‫ وبدون موافقة‬،‫للطرف الثاني الحق‬ .‫أ‬

and without consent of the ‫التمويل لنفسه والمشروع بإستخدام‬
‫ سواء من‬،‫التمويل من المقرضين‬
First Party, to finance itself ‫ وإبرام‬،‫داخل العراق أم من خارجه‬
‫ ويشمل ذلك‬،‫إتفاقيات ذات صلة‬
and the Project using funding ‫الضمانات العينية و التنازل مع هذه‬
‫ مع مراعاة إلتزام هذا‬، ‫الجهات‬
from Creditors, whether or not ‫ بما في ذلك‬،‫التمويل بالقانون النافذ‬
‫أية أنظمة أو تعليمات نافذة صادرة‬
located inside Iraq, and to

enter into any related

agreements, including

collateral security

assignments, with such

Persons, provided that such

financing is in compliance

with Applicable Law,

including any applicable

regulations and instructions

issued by the Central Bank of

Iraq.

b. The Second Party has the ‫ وبدون موافقة‬،‫يحق للطرف الثاني‬ .‫ب‬
right, without consent of the ‫ التعاقد مع مقاولين‬،‫الطرف الأول‬
First Party, to contract with ‫ وأن يف ّوض لهذا المتعاقد‬،‫ثانويين‬
Project Contractors and to ‫الثانوي أياً من حقوقه والتزاماته‬
delegate to such Project ‫المتصلة بتطوير وإكمال وتشغيل‬
Contractor, any of its rights ‫ بشرط بقاء الطرف الثاني‬،‫المشروع‬
and obligations relating to the ‫مسؤول ًا عن أية مخالفة يرتكبها‬
development, completion and ‫المتعاقد الثانوني لأي من الإلتزامات‬
operation of the Project,
provided, however, that the .‫بموجب هذا العقد‬
Second Party shall remain
responsible for any violation
of a Project Contractor of any
obligations under this
Contract.

c. To the extent permitted by ‫ وضمن الحدود‬،‫يحق للطرف الثاني‬ .‫ج‬

signs and marks or any other
