4. The Party whose obligations are ‫ﯾﻘﻮم اﻟﻄﺮف اﻟﺬي ﺗﺆﺛﺮ اﻟﻘﻮة اﻟﻘﺎھﺮة ﻋﻠﻰ‬
affected by such Force Majeure :‫أداء إﻟﺘﺰاﻣﺎﺗﮫ ﺑﻤﺎ ﯾﻠﻲ‬
shall do the following:

a. Exert its utmost efforts to ‫ﺑﺬل ﻗﺼﺎرى ﺟﮭﺪه ﻻزاﻟﺔ آﺛﺎر اﻟﻘﻮة‬ .‫أ‬
‫ وإﺳﺘﺌﻨﺎف أداء إﻟﺘﺰاﻣﺎﺗﮫ‬،‫اﻟﻘﺎھﺮة‬
remove the consequences of ‫ﺑﻤﻮﺟﺐ ھﺬا اﻟﻌﻘﺪ ﺑﺎﻟﺴﺮﻋﺔ اﻟﻤﻤﻜﻨﺔ‬
‫ﺑﻌﺪ إﻧﺘﮭﺎء اﻟﻘﻮة اﻟﻘﺎھﺮة أو إﻟﻰ اﻟﺤﺪ‬
the Force Majeure, resume ‫اﻟﺬي ﯾﺴﻤﺢ ﻟﮫ ﺑﺈﺳﺘﺌﻨﺎف أداء‬

meeting its obligations in .‫إﻟﺘﺰاﻣﺎﺗﮫ‬

accordance with this Contract

as soon as possible after the

Force Majeure has ended or to

the extent that it is allowed to

resume meeting its

obligations, and

b. Notify the other Party of its ‫إﺧﻄﺎر اﻟﻄﺮف اﻵﺧﺮ ﺑﻌﻠﻤﮫ ﺑﺈﻧﺘﮭﺎء‬ .‫ب‬
knowledge that the Force ‫اﻟﻘﻮة اﻟﻘﺎھﺮة وﺑﻤﻮﻋﺪ إﺳﺘﺌﻨﺎف أداء‬

date of the resumption of
meeting its obligations in .‫اﻟﻤﺤﺘﻤﻞ ﻹﺳﺘﺌﻨﺎﻓﮭﺎ‬
accordance with this Contract
or the possible date of
resumption.

5. If the First Party and the Second ‫إذا ﺗﺸﺎور اﻟﻄﺮف اﻷول ﻣﻊ اﻟﻄﺮف اﻟﺜﺎﻧﻲ‬
Party have consulted in accordance ‫ وﻟﻢ ﯾﺘﻤﻜﻨﺎ ﻣﻦ اﻟﺘﻮﺻﻞ اﻟﻰ‬20(3) ‫وﻓﻘﺎً ﻟﻠﻘﺴﻢ‬
with Section 20(3) and were unable ‫اﺗﻔﺎق ﺑﺸﺎن اﻟﻔﻘﺮﺗﯿﻦ ادﻧﺎه ﺧﻼل ﻣﺪة )ﻋﺪد‬
to accomplish the following within a ‫اﻷﯾﺎم أو اﻷﺷﮭﺮ( ﺑﻌﺪ ﺗﺎرﯾﺦ إﺳﺘﻼم اﻹﺷﻌﺎر‬
period of NUMBER OF DAYS OR ‫ ﻓﺎﻧﮭﻤﺎ ﺳﯿﻘﻮﻣﺎن‬20(2) ‫اﻟﻤﺸﺎر إﻟﯿﮫ ﻓﻲ اﻟﻘﺴﻢ‬
MONTHS after the date of receipt
of the notification referenced in :‫ﺑـ‬
Section 20(2), they shall:
a. Reach an agreement on the ‫اﻟﺘﻮﺻﻞ إﻟﻰ إﺗﻔﺎق ﻋﻠﻰ وﻗﻮع اﻟﻘﻮة‬ .‫أ‬
occurrence of Force Majeure, .‫اﻟﻘﺎھﺮة‬
and

b. Agree on appropriate steps to ‫ اﻹﺗﻔﺎق ﻋﻠﻰ ﺧﻄﻮات ﻣﻨﺎﺳﺒﺔ ﻟﺘﺨﻔﯿﻒ‬.‫ب‬
alleviate the consequences of .‫آﺛﺎر اﻟﻘﻮة اﻟﻘﺎھﺮة‬
the Force Majeure;
